Terms of Service
Terms for using the Real Deal mobile application and related services.
This document contains both our Terms of Service and our Privacy Policy for the Real Deal mobile application and related services ("Real Deal", "we", "us"). By creating an account or using Real Deal, you agree to these terms and acknowledge our privacy practices.
Part A — Terms of Service
1. Who we are
Real Deal connects people with local businesses through deals and offers. Contact: info@realdeal.bz.
2. Eligibility and accounts
You must be legally able to enter a binding contract in your jurisdiction. You are responsible for activity on your account and for keeping your device and phone number secure. You must provide accurate information.
3. The service
Real Deal may include discovery of deals, maps and location features, purchases, business tools, payments, and related functionality. We may change, suspend, or discontinue features with reasonable notice where practicable.
4. User conduct
You agree not to misuse the service: no unlawful activity, harassment, fraud, attempts to circumvent security, scraping that overloads our systems, or interference with other users or businesses. We may suspend or terminate access for violations.
5. Businesses
If you use Real Deal as a business, you are responsible for your listings, pricing, availability, compliance with applicable laws (including consumer and marketing rules), and honoring purchases made through the platform. You represent that you have authority to offer the deals you publish.
6. Purchases and payments
Payments may be processed by third-party providers (such as Stripe). Additional terms from the payment provider may apply. Prices, taxes, and currencies are shown as provided by businesses and our systems. When you buy a deal, the contract for the underlying goods or services is primarily between you and the business, as further described in section 15. Refunds, redemptions, chargebacks, and disputes are subject to section 17, applicable law, business policies where stated, and our processes as communicated in the app.
7. Intellectual property
Real Deal's name, branding, software, and content we create are owned by us or our licensors. You retain rights to content you submit; you grant us a license to host, display, and process that content to operate and improve the service.
8. Third-party services
The app may link to or rely on third parties (e.g. maps, analytics, authentication, payments). Their terms and privacy policies govern those services.
9. Disclaimers
The service is provided "as is" and "as available" to the extent permitted by law. We do not guarantee uninterrupted, error-free, or secure operation, or that the service will meet your requirements. Deals are offered by independent businesses; we are not responsible for the quality, safety, timing, or delivery of goods or services except where we expressly commit in writing. Map, location, and overlay features are subject to section 16. Visiting business premises is subject to section 18. Nothing in the service constitutes professional, legal, financial, or safety advice.
10. Limitation of liability
To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of Real Deal. Our aggregate liability for claims relating to the service is limited to the greater of (a) the amount you paid us for the service in the twelve (12) months before the claim or (b) one hundred (100) NOK, except where liability cannot be limited by law.
11. Indemnity
You agree to indemnify and hold harmless Real Deal and its affiliates, officers, and employees from claims, damages, and expenses (including reasonable legal fees) arising from your use of the service, your content, or your violation of these terms, to the extent permitted by law.
12. Governing law and disputes
Unless mandatory local law requires otherwise, these terms are governed by the laws of Norway. Courts in Norway shall have exclusive jurisdiction, subject to non-waivable rights you may have as a consumer in your country of residence.
13. Changes
We may update these terms. We will post the new date at the top and, where changes are material, provide notice in the app or by other reasonable means. Continued use after the effective date constitutes acceptance where permitted by law.
14. Termination
You may stop using Real Deal at any time. We may suspend or terminate access for breach of these terms, risk, or legal requirements.
15. Our role (marketplace)
Real Deal operates as a platform that helps users discover deals and transact with independent businesses. Unless we clearly state otherwise in writing, we are not the seller, merchant of record, or agent of the business for the underlying goods or services. Businesses are responsible for their offers, descriptions, availability, eligibility rules, taxes where applicable, and performance. You agree that your legal relationship for the purchase itself is primarily with the business, and that claims relating to the good or service should first be directed to that business, except where mandatory consumer law requires otherwise.
16. Maps, location, and map layers
Map views, pins, geofences, routes, heatmaps, highlights, and any other layers or overlays (now or added later) are provided for general information and convenience only. They are not intended for primary navigation, emergency response, safety-critical decisions, or compliance with traffic, maritime, aviation, or other regulations. Map data, deal locations, distances, and boundaries may be inaccurate, incomplete, or outdated. You must rely on your own judgment, official signage, and lawful use of roads and premises. Third-party map and location providers (e.g. Mapbox, Google, Apple, device GPS) supply data under their own terms and may change or restrict usage. To the fullest extent permitted by applicable law, we disclaim liability for errors, omissions, or delays in map or location content and for decisions you make based on them.
17. Redemptions, refunds, no-shows, expired deals, and chargebacks
You must follow each business’s redemption instructions and any deadlines, capacity limits, or conditions shown in the app or at the venue. Expired, unused, or partially used deals may not be refundable unless required by law or expressly stated otherwise by the business or in the app. No-shows, late arrivals, or cancellations may result in forfeiture of payment or fees according to the business’s stated policy and applicable law. If you have a dispute about quality, fulfillment, or refunds, you agree to contact the business first and cooperate with reasonable requests for information. We may, but are not obligated to mediate or assist, and any goodwill steps we take do not waive these terms.
If you initiate a chargeback or payment reversal, you will cooperate with us and the payment provider in good faith. Where permitted by law and payment rules, we may recover amounts, offset balances, restrict features, or suspend or terminate accounts for abusive, fraudulent, or unjustified payment disputes. You are responsible for any fees, penalties, or losses we incur because of your payment dispute, to the extent permitted by law.
18. Premises, safety, and personal injury
Businesses control their own premises, staff, products, and operations. Your visit to any business location is at your own risk to the extent permitted by applicable law. To the fullest extent permitted by applicable law, Real Deal is not responsible for personal injury, illness, property damage, theft, assault, food safety, allergies, accessibility, parking, construction hazards, crowd conditions, or any other harm arising from your presence at or use of third-party premises or services, or from interactions with businesses or other customers. We do not inspect, warrant, or guarantee that any venue is safe, suitable, or lawful for you. This section does not limit liability that cannot be limited by mandatory law (including certain consumer or personal-injury rules where they apply).
19. Force majeure
To the extent permitted by applicable law, we are not liable for delay or failure to perform caused by events beyond our reasonable control, including internet or telecommunications outages, cyber incidents (except those caused solely by our gross negligence where that cannot be excluded), strikes, natural disasters, pandemics, war, government action, or failures of third-party providers.
